ఈ ఏడాది మార్చిలో సుప్రీంకోర్టు తన పాత తీర్పును రద్దు చేసి ఆరుగురు ఖైదీలను నిర్దోషులుగా ప్రకటించి విడుదల చేసింది. కానీ.. చేయని నేరానికి 16 ఏళ్ళు జైలులో గడిపిన వాళ్ళ జీవితాల పరిస్థితి ఏమిటి? న్యాయ వ్యవస్థకు మచ్చ తెచ్చే ఇలాంటి తీర్పులను ఎలా చూడాలి? బీబీసీ ప్రతినిధి సౌతిక్ బిస్వాస్ కథనం.
ఈ ఆరుగురిలో ఐదుగురు 16 ఏళ్ళ పాటు జైలులో బతకడమే కాదు, అందులో 13 ఏళ్ళు మరణశిక్ష విధించబడ్డ ఖైదీలుగా గడిపారు. ఆరో వ్యక్తి వయస్సు అప్పటికింకా నిర్ధారణ కాకపోవడం వల్ల మిగతావాళ్ళతో పాటు అతని మీద కూడా కేసు నడిపి వాళ్లకు విధించినట్టుగానే అతనికీ ఉరిశిక్ష విధించారు. అయితే హత్యలు జరిగిన సమయానికి అతని వయస్సు 17 సంవత్సరాలని తర్వాత రుజువవడంతో 2012లో వదిలిపెట్టారు.
వీరందరూ ఒంటరిగా కిటికీలు లేని ఇరుకు గదుల్లో మరణశిక్ష అనే ఖడ్గం తలపై వేలాడుతుండగా 13 ఏళ్ళ జీవితాన్ని గడిపారు. రాత్రంతా గది బయట కళ్ళు బైర్లు కమ్మే వెలుతురు దీపాలు. అప్పుడప్పుడు వినిపించే ఖైదీల ఆర్తనాదాలు మినహా భీతి గొలిపే నిశ్శబ్దం. జైలు జీవితం ''నాగుపాము గుండెల మీద కూర్చున్నట్టు ఉండేద''ని ఒకరంటే.. ''ఉరి తీయబడ్డ మనుషులు దెయ్యాలుగా'' రాత్రంతా కలల్లోకి వచ్చేవని మరొకరు చెప్పారు.
పగటిపూట కొన్ని గంటలు బయటికి వెళ్ళనిచ్చినా అక్కడ ఒక్కోసారి మూర్ఛ వచ్చి పడిపోయిన ఖైదీలో, ఆత్మహత్యా ప్రయత్నం చేస్తున్న ఖైదీనో కనబడి మరింత కలవరపడేవాడినని ఒకతను అన్నాడు. కడుపులో అల్సర్ వచ్చి మంటగా ఉన్నా ఎటువంటి వైద్య సహాయం లభించేది కాదన్నాడు. ''ఏళ్ళ తరబడి నిత్య మరణ భయంతో అమానవీయ పరిస్థితుల్లో బతికాడు'' అని ఆ యువకుడ్ని పరీక్షించిన ఇద్దరు డాక్టర్లు చెప్పారు. ఆ ఆరుగురి అభాగ్యుల పేర్లు: అంబాదాస్ లక్ష్మణ్ షిండే, బాపు అప్పా షిండే, అంకుశ్ మారుతి షిండే, రాజ్య అప్పా షిండే, రాజు మాసు షిండే, సురేష్ నాగు షిండే.

మహారాష్ట్రలోని నాసిక్ దగ్గర జామకాయల తోటలో పని చేసే ఒక కుటుంబానికి చెందిన ఐదుగురు కూలీలను హత్య చేశారని వారిపై అభియోగం. ఈ సంఘటన 2003 లో జరిగింది. అప్పుడు వారి వయస్సు 17-30 సంవత్సరాల మధ్య ఉంది. పదిహేడేళ్ల అంకుశ్ మారుతి అందరిలోకి చిన్నవాడు.
తప్పుడు కేసులో ఇరికించారు
జూన్ 2006 - మొత్తం ఆరుగురికీ పుణే సెషన్స్ కోర్టు మరణశిక్ష విధించింది
మార్చి 2007 - బొంబాయి హైకోర్టు ముగ్గురి మరణశిక్షలు జీవిత ఖైదుగా మార్చింది
ఏప్రిల్ 2009 - అప్పీళ్ళను సుప్రీంకోర్టు తోసిపుచ్చి ఆరుగురికీ మరణశిక్షలగ ఖరారు చేసింది
అక్టోబర్ 2018 - తీర్పు సమీక్షకు సుప్రీంకోర్టు అంగీకరించింది
మార్చి 2019 - పాత తీర్పును రద్దు చేసి మొత్తం ఆరుగురినీ తప్పుడు కేసులో ఇరికించారని తీర్పు చెప్పింది
షిండేలు సంచార ఆదివాసీ తెగకు చెందినవారు. నిరుపేదలు. ఎక్కువగా మట్టి తవ్వకాలు, చెత్తను ఎత్తి పారబోయడం, మురికి కాలవలను శుభ్రం చేయడం, పొలాలలో కూలీలుగా పనులు చేస్తుంటారు. మొత్తం 13 ఏళ్ళలో ఏడుగురు జడ్జీలు మూడు కోర్టులలో విచారణ జరిపి వారిని దోషులుగా తేల్చారు. కానీ అందరూ తప్పే చేశారని తేలింది.
వారి మరణశిక్షలను రద్దు చేస్తూ సుప్రీంకోర్టు ఇప్పుడు ఇచ్చిన ఈ తీర్పు ఓ మైలురాయి లాంటిదని చెప్పాలి. అత్యున్నత న్యాయస్థానం తన చరిత్రలో మొట్టమొదటిసారిగా.. తానే విధించిన ఒక మరణ శిక్ష తీర్పును వెనక్కి తీసుకుంది. అంతే కాదు.. వారి మీద తప్పుడు అభియోగం మోపారని, కోర్టులు చాలా తీవ్రమైన పొరపాటు చేశాయని జడ్జీలు వ్యాఖ్యానించారు. ''పోలీసు దర్యాప్తు గానీ, కోర్టు విచారణ గానీ న్యాయంగా జరగలేదని'', నిందితుల హక్కుల ఉల్లంఘన జరిగిందని అభిప్రాయపడ్డారు.
''పోలీసు, ప్రాసిక్యూషన్ వ్యవహరించిన తీరును మేము తీవ్రంగా ఖండిస్తున్నాం'' అని జడ్జీలు 75 పేజీల తమ అసాధారణమైన తీర్పులో పేర్కొన్నారు. ''అసలు దోషులు శుభ్రంగా తప్పించుకుపోయారు'' అని కూడా వ్యాఖ్యానించారు. అప్పీళ్లను తిరస్కరించిన పదేళ్ళ తర్వాత సుప్రీంకోర్టు ఈ తీర్పు ప్రకటించింది.
కేసును దర్యాప్తు చేయడంలో ''పూర్తి నిర్లక్ష్యం లేదా దోషపూరితమైన లోపాలు'' జరిగాయని చెపుతూ సంబంధిత పోలీసు అధికారులపై చర్యలు తీసుకోవలసిందిగా న్యాయమూర్తులు ఆదేశించారు. నిందితులందరికీ పునరావాసం కోసం నెల రోజుల లోపల 5 లక్షల రూపాయల చొప్పున నష్టపరిహారం చెల్లించాలని కూడా ఆదేశించారు. అంటే వారు జైలులో ఉన్న ప్రతి నెలకూ రూ. 2,600 చొప్పున లెక్క కట్టినట్టు. వారిని కలవడానికి ఇటీవల నేను వారుంటున్న ఊరికి వెళ్లాను. అది మహారాష్ట్రలోని జైన జిల్లాలో భోకర్దన్ అనే ఊరు. నిత్య క్షామ పీడిత ప్రాంతం.

ఆ ఆరుగురిలో ఇద్దరు అన్నదమ్ములు. మిగతావారు కూడా దగ్గర బంధువులే. అందరూ ఒక రకమైన ఒత్తిడిలో, కుంగుబాటులో ఉన్నట్టు కనిపించారు. ఆ రోజుకు నష్టపరిహారం వారికి ఇంకా అందలేదు. ''మరణశిక్ష పడ్డ ఖైదీలుగా ఎన్నో ఏళ్ళు బతకడంతో మా ఇంద్రియాలన్నీ మొద్దుబారిపోయాయి. కాలగమన స్పృహ లేకుండా పోయింది. అన్ని జీవక్రియలూ నెమ్మదించాయి. మళ్ళీ పని చేయడానికి శక్తి సరిపోవడం లేదు'' అని చెప్పారు వాళ్ళు.
అందరూ అధిక రక్తపోటు, మధుమేహం, నిద్రలేమి, కంటిచూపు మందగించడం వంటి సమస్యలతో బాధపడుతున్నారు. రోజులకు రోజులు నాటు సారా మత్తులో గడిపారు వాళ్ళు. కొందరైతే నిద్రబిళ్ళలు, కుంగుబాటును తగ్గించే మందులు వాడుతున్నారు. ''నేను రోజూ అరడజను గోళీలైనా మింగుతాను. అయినా నీరసంగానే ఉంటోంది. డాక్టర్ దగ్గరకు వెళ్ళినప్పుడల్లా సెలైన్ పెడతాడు. అదిచ్చే శక్తితో ఈ మాత్రమైనా తిరగగలుగుతున్నా'' అని చెప్పాడు 49 ఏళ్ళ బాపు అప్పా షిండే.
''జైలు జీవితం మనిషిని నెమ్మది నెమ్మదిగా, దొంగదెబ్బ కొట్టినట్టుగా చంపేస్తుంది. కానీ బయటికొచ్చాక చూస్తే ఈ స్వేచ్ఛ కూడా దుఃఖభరితంగానే అనిపిస్తోంది'' అన్నాడాయన. వీళ్ళు జైలుకు వెళ్ళాక వీళ్ళ భార్యలు, పిల్లలు తమ మగవారు చేసిన పనులే చేస్తూ బతికారు. కాలవలను, బావులను శుభ్రం చేస్తూ, చెత్త ఎత్తి పోస్తూ కడుపు నింపుకున్నారు. పిల్లల్లో ఎక్కువమంది స్కూల్ కు వెళ్ళలేదు. ఏళ్ళ తరబడి వానలు కురవని కరువు ప్రాంతం కాబట్టి వాళ్ళ ఊర్లలో పొలం పనులంటూ పెద్దగా ఏమీ ఉండవు.
''మా కుటుంబాలకు కలిగిన కష్టం అంతా ఇంతా కాదు. ఎంత పరిహారం ఇచ్చినా ఆ నష్టాన్ని ఎవరూ పూడ్చలేరు'' అంటున్నారు వీరు. 2008 లో బాపు అప్పా 15 ఏళ్ళ కొడుకు రాజు మట్టి పని చేస్తుంటే కరెంటు వైరు తగిలి షాక్తో చనిపోయాడు. ''మా ఇంట్లో అందరి కంటే తెలివైనవాడు వాడు. నేను జైలుకు వెళ్లకుంటే వాడికి రోడ్ల మీద పని చేయాల్సిన అవసరం వచ్చేదే కాదు'' అని తండ్రి ఆవేదనగా అన్నాడు. బాపు అప్పా తమ్ముడు రాజ్య అప్పా. అన్నదమ్ములు జైలు నుంచి వచ్చేసరికి అసలే అంతంత మాత్రంగా ఉండిన వారి ఇల్లు పూర్తిగా కుప్పకూలిపోయి కనిపించింది.
వారి కుటుంబాలు ఒక నిర్జన ప్రభుత్వ భవంతి ఆవరణలో చెట్టు కింద నివాసం ఉంటున్నాయి. తండ్రులు వస్తున్నారని తెలిసి వారి పిల్లలు ఈ మధ్యే ఒక రేకుల షెడ్డు వేశారట. ''మేము ఇప్పుడు స్వేచ్ఛాజీవులం నిజమే.. కానీ నిరాశ్రయులుగా మిగిలాం'' అన్నాడు రాజ్య అప్పా నిర్వేదంగా. రాజు షిండేని పోలీసులు అరెస్టు చేసే నాటికి అతనికి పెళ్ళయి మూడు నెలలే అయింది. అతని భార్య 12 ఏళ్ళ క్రితమే అతన్ని వదిలేసి ఇంకొక వ్యక్తితో వెళ్ళిపోయింది.

''వేరే వ్యక్తితో వెళ్ళిపోవడానికి 12 రోజుల ముందు ఆమె నన్ను చూడడానికి జైలుకు వచ్చింది. కానీ నన్ను వదిలి పెట్టి పోతున్నట్టు చెప్పనే లేదు. ఆమె మీద ఆమె కుటుంబం ఒత్తిడి ఉండి ఉండొచ్చు'' అన్నాడు రాజు. ఈ మధ్యే అతను కూడా మళ్ళీ పెళ్లి చేసుకున్నాడు. ఈ 16 ఏళ్ళలో ఇద్దరు వ్యక్తులు తమ తల్లిదండ్రులను కోల్పోయారు. కొడుకులకు ఉరిశిక్ష పడిందన్న వార్త విని గుండెపోట్లకు గురై ఆ జబ్బుతోనే అస్వస్థులై మరణించారు. జైలు ములాఖత్ కోసం వారి కుటుంబాలు అప్పుడప్పుడూ నాగపూర్కి వెళ్ళేవి. చాలాసార్లు టికెట్ లేకుండానే వెళ్ళాల్సి వచ్చేది.
"టికెట్ కలెక్టర్లు పట్టుకున్నపుడు మా భర్తలు జైలులో ఉన్నారని, మేము పేదవాళ్ళమని, మా దగ్గర డబ్బులు లేవని చెప్పేవాళ్ళం. కొన్నిసార్లు దయ చూపించేవారు, కొన్నిసార్లు రైల్లోంచి బయటికి గెంటేసేవాళ్ళు. డబ్బుల్లేని వాళ్లకు ఎక్కడా గౌరవం ఉండదు'' అని చెప్పింది వారిలో ఒకరి భార్య అయిన రాణి షిండే. ''మా జీవితాలు పూర్తిగా నాశనమయ్యాయి. మా బతుకుతెరువులు ధ్వంసమయ్యాయి. చేయని నేరానికి అన్నీ పోగొట్టుకున్నాం'' అంది ఆమె.
పదహారేళ్ల కిందట ఏం జరిగింది?
2003 జూన్ 5వ తేదీ రాత్రి నాసిక్ లోని ఒక జామ తోటలో గుడిసె వేసుకుని ఉంటున్న కుటుంబంలోని ఐదుగురు సభ్యుల్ని చంపారనేది వీరి మీద ఉన్న అభియోగం. నిజానికి షిండేల ఊరికి నాసిక్ దాదాపు 300 కిలోమీటర్ల దూరం. ఆ కుటుంబంలో ఇద్దరు ఎలాగో తప్పించుకుని బయటపడ్డారు. ఒక ఆడమనిషి, ఆమె కొడుకు. ఏడెనిమిది మంది మగవాళ్ళు కత్తులు, కట్టెలు, కొడవళ్ళతో గుడిసెలోకి వచ్చి తమ వాళ్ళను చంపారని వాళ్ళే పోలీసులకు చెప్పారు.
కరెంటు సౌకర్యం కూడా లేని గుడిసె అది. వచ్చిన వాళ్ళు హిందీలో మాట్లాడారని, బొంబాయి నుంచి వచ్చినట్టు చెప్పారని ఆమె వివరించింది. టేప్ రికార్డర్లో తాము వింటున్న పాటల సౌండ్ బాగా పెంచి ఎవరికీ ఏమీ వినబడకుండా చేశారని, ఇంట్లో ఉన్న నగలు, నగదు మొత్తం ఇచ్చేయమని బెదిరించారని, రూ. 6,500 విలువ చేసే నగలు, డబ్బు ఇచ్చామని ఆమె చెప్పింది. ఆ తర్వాత వారు మద్యం తాగి వాళ్ళ మీద దాడి చేసి ఇద్దరు ఆడవాళ్ళతో సహా ఐదుగుర్ని చంపారు. ఆ ఇద్దరిలో ఒకర్ని చంపే ముందు రేప్ కూడా చేశారట. చనిపోయిన వారి వయస్సు 13 ఏళ్ళ నుండి 48 ఏళ్ళ వరకు ఉంది.
మర్నాడు పోలీసులొచ్చి చూసి క్యాసెట్లు, ఒక కొయ్య కర్ర, ఒక కొడవలి, 14 జతల చెప్పులు స్వాధీనం చేసుకున్నారు. రక్తపు మరకలు, వేలిముద్రలు కూడా సేకరించారు. హత్యలు జరిగిన మర్నాడు పోలీసులు తమ వద్ద ఉన్న స్థానిక నేరస్తుల ఫోటో ఆల్బంను తీసుకొచ్చి ప్రత్యక్ష సాక్షికి చూపించారు. ఆ ఫోటోల్లోంచి ఆమె 19-35 ఏళ్ళ మధ్య వయసున్న నలుగురు మగవాళ్ళను గుర్తించి మేజిస్ట్రేట్ ముందు వారే తన కుటుంబ సభ్యులను చంపారని చెప్పింది.
''వారు స్థానిక నేరస్తులు కాబట్టి పోలీసు రికార్డులలో ఉన్నారు'' అని ఒక లాయరు చెప్పాడు. అయితే పోలీసులు, ప్రాసిక్యూషన్ కూడా ఈ ''సాక్ష్యాన్ని మరుగుపరిచి'' ఆ నలుగుర్ని అరెస్టు చేయలేదని సుప్రీంకోర్టు వ్యాఖ్యానించింది. వారి బదులు మూడు వారాల తర్వాత షిండేలను అరెస్టు చేశారు. నిజానికి వాళ్లెప్పుడూ నాసిక్కు వెళ్ళలేదు. అయినా అనుమానించి తమను లాకప్లో చిత్రహింసలు పెట్టారని, ''కరెంటు షాకులు ఇచ్చి, తీవ్రంగా కొట్టి'' ఒప్పుకోలు పత్రాలపై సంతకాలు చేయించుకున్నారని షిండేలు చెప్పారు.
విచిత్రమేమిటంటే ఆ కుటుంబానికి చెందిన ప్రత్యక్ష సాక్షే వీర్ని గుర్తించడం. అదే వారి పాలిట యమపాశం అయింది. కేవలం ఆమె సాక్ష్యం ఆధారంగానే వారికి శిక్షలు పడ్డాయి. 2006 లో పూణె కోర్టు వారిని దోషులుగా నిర్ధారించి మొత్తం అందరికీ మరణశిక్ష విధించింది. నలుగురు వేరు వేరు పోలీసు ఆఫీసర్లు దర్యాప్తు చేశాక, ప్రాసిక్యూషన్ 25 మంది సాక్షులను విచారించాక వచ్చిన తీర్పు అది. తర్వాత పదేళ్లకు పైగా కేసు బొంబాయి హైకోర్టు, సుప్రీంకోర్టుల చుట్టూ తిరిగింది. అన్ని చోట్లా శిక్షలు ఖరారు అయ్యాయే గాని వారికి న్యాయం లభించలేదు.
బొంబాయి హైకోర్టు ముగ్గురి మరణ శిక్షలను యావజ్జీవ ఖైదుగా మారిస్తే కూడా సుప్రీంకోర్టు మళ్ళీ ఆ తీర్పును మార్చేసి వారికి కూడా శిక్షలు ఖరారు చేసింది. షిండేలకు ఈ హత్యలతో ఎలాంటి సంబంధమూ లేదని రుజువు చేయగల సాక్ష్యాధారాలు పుష్కలంగా ఉన్నా కోర్టులు వాటిని పట్టించుకోలేదు. గుడిసె లోపలా, బయటా పోలీసులు సేకరించిన వేలిముద్రలు షిండేల వేలిముద్రలతో సరిపోలేదు. షిండే సోదరుల నుండి రక్తం, డీఎన్ఏ నమూనాలు తీసుకున్నారు గానీ వాటి ఫలితాలను కోర్టుకు సమర్పించలేదు.

''ఆ ఫలితాలు వారిని దోషులుగా నిర్ధారించినట్టు లేవు'' అని మార్చిలో కేసు కొట్టేస్తూ సుప్రీంకోర్టు జడ్జి వ్యాఖ్యానించారు. దొంగిలించిన సొత్తు కూడా వారి వద్ద ఏమీ పట్టుబడలేదు. ఆగంతకులు హిందీలో మాట్లాడారని ప్రత్యక్ష సాక్షులు పోలీసులకు చెప్పారు. అయినా మరాఠీ మాత్రమే వచ్చిన షిండేలను దోషులుగా నిర్ధారించారు.
వీరి తరఫున దశాబ్దం పైగా పోరాడిన యుగ్ చౌధరి బొంబాయిలో లాయరు. ఆయన వారి తరఫున గవర్నర్కు, రాష్ట్రపతికి, అడ్వకేట్ జనరల్కు క్షమాబిక్ష పిటిషన్లు దాఖలు చేశారు. షిండేలతో సహా 13 మంది మరణశిక్షలను రద్దు చేయాలని కోరుతూ ఆయన మాజీ న్యాయమూర్తుల చేత రాష్ట్రపతికి ఒక లేఖ రాయించారు. ''అన్యాయంగా మరణశిక్షలు విధించబడ్డ వాళ్ళకు ఆ శిక్షలను అమలు జరిపితే న్యాయవ్యవస్థ విశ్వసనీయత తీవ్రంగా దెబ్బ తింటుంది'' అని వారు ఆ లేఖలో రాశారు.
16 ఏళ్ళ తర్వాత కూడా ఈ నేరానికి సంబంధించి పలు సందేహాలు ఉన్నాయి. కేవలం ఒక ప్రత్యక్ష సాక్షి అనుమానాస్పద సాక్ష్యాన్ని ఆధారం చేసుకుని కోర్టులు ఏకంగా మరణశిక్ష ఎలా విధించాయి? దీనికి లాయర్లు చెప్పే జవాబు ఏమిటంటే ''ఘోరమైన నేరం'' కాబట్టి వెంటనే న్యాయం జరగాలని ప్రజలు, మీడియా డిమాండ్ చేయడం వల్ల జడ్జీలు ఒత్తిడికి లోనై ఆ పని చేసి ఉండొచ్చనేది.
మరో సందేహం - ప్రత్యక్ష సాక్షి మొదట గుర్తించిన నలుగురిని పోలీసులు ఎందుకు అరెస్టు చేసి దర్యాప్తు చేయలేదు? కేసు ఫైళ్ళలో దీనికి ఎలాంటి వివరణ లేదని సుప్రీంకోర్టు తన రెండో తీర్పులో పేర్కొంది. ప్రత్యక్ష సాక్షి మాట మార్చి వేరేవాళ్ళను నేరస్తులుగా ఎందుకు గుర్తించింది? మతిమరుపు వల్లా, పొరపాటు పడిందా లేక పోలీసులు ఏమైనా ఒత్తిడి పెట్టారా? సమాధానం ఎవరికీ తెలియదు. అంతకంటే ముఖ్యమైన విషయం 300 కిలోమీటర్ల దూరంలో నివసించే ఆరుగురు అమాయకులను పోలీసులు ఈ కేసులో ఎందుకు ఇరికించి అరెస్టు చేయవలసి వచ్చింది?
ప్రత్యేక నిఘా పెట్టాల్సిన వాళ్ళు
షిండేలు సంచార ఆదివాసీ తెగకు చెందిన పేదవారు కావడమే దానికి కారణమని లాయర్ల అభిప్రాయం. పైగా వారి తెగ బ్రిటిష్ కాలంలో 'నేరస్త జాతి'గా ముద్ర పడ్డ తెగ. ఇటువంటి జాతుల మీద ఎల్లప్పుడూ 'ప్రత్యేక నిఘా' ఉంచాలని, ఆ జాతి వాళ్ళను 'అనుమానాస్పద వ్యక్తులు'గా చూడాలని పోలీసు మాన్యుయల్ చెపుతుంది.
ఈ ఆరుగురిలో ముగ్గురు నాసిక్ హత్యల కంటే నెల రోజుల ముందు జరిగిన ఒక హత్య కేసులో ఆరోపణలు ఎదుర్కొన్నారు కాని 2014లో వారు నిర్దోషులని పేర్కొంటూ కోర్టు తీర్పు వచ్చింది. నాసిక్ కేసులో వీరిని నిర్దోషులుగా ప్రకటించిన ముగ్గురు సుప్ర్రీంకోర్టు జడ్జీలు కూడా ఇంచుమించు పై అభిప్రాయమే వ్యక్తం చేశారు.

''నిందితులు సమాజపు అట్టడుగు వర్గానికి చెందిన సంచార తెగ వాళ్ళు. అత్యంత నిరుపేద కూలీలు. తీవ్రమైన నేరాలు జరిగినప్పుడు అమాయకులను వాటికి బాధ్యులను చేయడం తరచూ జరుగుతున్న విషయమే కాబట్టి వీరిని కావాలనే తప్పుడు కేసులో ఇరికించి ఉండవచ్చు'' అని జడ్జీలు తమ తీర్పులో రాశారు.
అంతిమంగా మనం గమనించాల్సిందేమిటంటే ఈ దేశ న్యాయవ్యవస్థ తప్పుడు కేసులను కనిపెట్టలేని బలహీన స్థితిలో ఉందని, పేదల పట్ల చాలా వ్యతిరేకత కలిగి ఉందని. ''తప్పులు జరగడానికి ఇంతగా అవకాశం ఉన్న న్యాయవ్యవస్థలో మరణశిక్షను ఒక శిక్షగా కొనసాగించడం వల్ల ఎన్ని అనర్ధాలు జరగవచ్చో పేదలకు కలుగుతున్న ఇలాంటి కష్టనష్టాల నుండి గ్రహించవచ్చు'' అని దిల్లీలోని నేషనల్ లా యూనివర్సిటీ అధ్యాపకుడిగా పని చేస్తున్న అనూప్ సురేంద్రనాథ్ అంటారు.
''ఆరుగురు అమాయకులపై తప్పుడు అభియోగాలు మోపిన దర్యాప్తు అధికారుల అక్రమాలను సుప్రీంకోర్టుతో సహా మూడు కోర్టులు కనిపెట్టలేనపుడు న్యాయంగా మరణశిక్షలు విధించగల సామర్థ్యం గల న్యాయవ్యవస్థ మనకు ఉందని అనుకోలేము'' అని ఆయన వ్యాఖ్యానించారు. దాదాపు 400 మంది మరణశిక్ష విధించబడ్డ ఖైదీలు నేడు భారతదేశ జైళ్లలో ఉన్నారనేది మరవకండి
